How Division Of Property Is Handled

Texas is a community property state. This means that any assets or property obtained after the marriage has taken place are considered community property. This also means that they are subject to division in the property division part of the divorce. Typically divided as close to 50-50 as possible, some assets that are subject to division include:

  • Personal property (cars, jewelry and more)
  • Retirement accounts (IRAs, Roth IRAs, and 401(k)s

Alimony May Be Possible

Also called spousal support or spousal maintenance, alimony is the amount of money paid from one spouse to the other in order to support their lifestyle during the divorce and after. Not all divorces call for alimony. Situations, where both parties made fairly equal salaries and contributed equally to the financial stability of the marriage, may make alimony moot. However, the court considers several factors when determining if alimony is appropriate, including:

  • How old the parties are
  • How long they have been married
  • How much each contributed financially to the marriage
  • How much money each could possibly earn in the future
  • Any fault in the marriage
